Selon elle, la d\u00e9rogation dont b\u00e9n\u00e9ficie la France est express\u00e9ment pr\u00e9vue \u00e0 l\u2019article 6 de la directive 95\/1\/CE. Cet article autorisait effectivement les Etats membres \u00e0 refuser l\u2019immatriculation, sur leur territoire, des motocyclettes ayant une puissance maximale nette sup\u00e9rieure \u00e0 74kW. La commission semble toutefois avoir oubli\u00e9 que cette d\u00e9rogation n\u2019avait qu\u2019un caract\u00e8re temporaire. En effet, l\u2019article 3 de la m\u00eame directive octroyait \u00e0 la Commission un d\u00e9lai de deux ans pour \u00e9tablir, par le biais d\u2019une \u00e9tude approfondie, un lien entre les accidents et une puissance maximale du moteur sup\u00e9rieure \u00e0 74kW, et pour arr\u00eater, le cas \u00e9ch\u00e9ant, des recommandations d\u00e9finitives. <\/p>\n<p>Malgr\u00e9 les conclusions de cette \u00e9tude (rapport TNO paru en 1997) d\u00e9montrant qu\u2019il n\u2019y avait aucune corr\u00e9lation entre l\u2019accidentologie des motos et le fait qu\u2019elles fassent ou non plus de 74 kw, la Commission n\u2019a pas boug\u00e9. <br \/>Pourtant, d\u00e8s 1998, elle aurait du supprimer la d\u00e9rogation accord\u00e9e \u00e0 la France qui s\u2019av\u00e9rait totalement injustifi\u00e9e. <\/p>\n<p>Car, si le trait\u00e9 CE autorise les Etats \u00e0 adopter des limitations au principe de libre circulation de marchandises, celles-ci doivent cependant \u00eatre d\u00fbment justifi\u00e9es.
