C\u2019est pourquoi nous exposions hier le point de vue du <a href=\"http:\/\/www.codever.fr\/\">CODEVER<\/a> et celui de <a href=\"http:\/\/www.fne.asso.fr\/\">France Nature Environnement<\/a> \u00e0 qui nous devons la liberticide Loi Lalonde.&nbsp; Pour clore provisoirement ce dossier, nous donnons aujourd\u2019hui la parole \u00e0&nbsp; <a href=\"http:\/\/www.localtis.info\/servlet\/ContentServer?c=artVeille&amp;pagename=Localtis%2FartVeille%2FartVeille&amp;cid=1167285481915\">Xavier Sidaner<\/a> de <a href=\"http:\/\/www.environnement-online.com\/index.asp?uid=\">Victoires Editions<\/a>.<\/p>\n<p>\u00ab <em>L\u2019arr\u00eat du<a href=\"http:\/\/www.conseil-etat.fr\/ce\/home\/index.shtml\"> Conseil d&rsquo;Etat<\/a> a valid\u00e9 la circulaire du 6 septembre 2005, relative aux r\u00e8gles imposables aux utilisateurs de v\u00e9hicules terrestres \u00e0 moteur dans les espaces naturels.<br \/> Le <a href=\"http:\/\/www.conseil-etat.fr\/ce\/home\/index.shtml\">Conseil d&rsquo;Etat<\/a> a uniquement annul\u00e9 l&rsquo;annexe 1 de cette circulaire, car elle ne mentionnait pas que le permis B1 n&rsquo;\u00e9tait requis que pour les quadricycles lourds \u00e0 moteur.<br \/> Contrairement \u00e0 ce que pr\u00e9tendent les requ\u00e9rants (le Collectif pour la d\u00e9fense des loisirs verts, <a href=\"http:\/\/www.codever.fr\/\">CODEVER<\/a>, la <a href=\"http:\/\/www.ffmoto.org\/\">F\u00e9d\u00e9ration Fran\u00e7aise de Motocyclisme<\/a> et la <a href=\"http:\/\/www.ff-4x4.com\/site\/\">F\u00e9d\u00e9ration Fran\u00e7aise de 4X4<\/a>-ndlr) le <a href=\"http:\/\/www.conseil-etat.fr\/ce\/home\/index.shtml\">Conseil d\u2019Etat<\/a> a jug\u00e9 que la circulaire attaqu\u00e9e n&rsquo;a eu ni pour objet ni pour effet de porter atteinte \u00e0 la libert\u00e9 d&rsquo;aller et venir&nbsp; et qu&rsquo;elle n&rsquo;avait pas proc\u00e9d\u00e9 \u00e0 une interpr\u00e9tation inexacte des dispositions issues de l&rsquo;article L.2213-4 du Code g\u00e9n\u00e9ral des collectivit\u00e9s territoriales donnant aux maires la possibilit\u00e9 d&rsquo;interdire l&rsquo;acc\u00e8s de certaines voies ou de certaines portions de voies de leur commune aux v\u00e9hicules dont la circulation sur ces voies est de nature \u00e0 compromettre soit la tranquillit\u00e9 publique, soit la qualit\u00e9 de l&rsquo;air, soit la protection des esp\u00e8ces animales ou v\u00e9g\u00e9tales.<br \/> La circulation des engins non-immatricul\u00e9s ou non-r\u00e9ceptionn\u00e9s (c&rsquo;est-\u00e0-dire n&rsquo;\u00e9tant pas pass\u00e9s par le <a href=\"http:\/\/fr.wikipedia.org\/wiki\/Passage_aux_Mines\">Service des Mines<\/a>) est donc uniquement limit\u00e9e \u00e0 la propri\u00e9t\u00e9 du conducteur du v\u00e9hicule et aux terrains am\u00e9nag\u00e9s et autoris\u00e9s conform\u00e9ment \u00e0 l&rsquo;article L.442-1 du Code de l&rsquo;environnement.<br \/> Un projet de d\u00e9cret actuellement en pr\u00e9paration viserait \u00e0 renforcer, conform\u00e9ment aux <a href=\"http:\/\/www.securiteroutiere.equipement.gouv.fr\/infos-ref\/politique\/organisation\/cisr\/\">d\u00e9cisions du Comit\u00e9 Interminist\u00e9riel de la S\u00e9curit\u00e9 Routi\u00e8re du 1er juillet 2005<\/a>, la r\u00e9pression de l&rsquo;usage d&rsquo;un engin d\u00e9brid\u00e9 ou d&rsquo;un engin non-r\u00e9ceptionn\u00e9 sur voie ouverte \u00e0 la circulation publique <\/em>\u00bb<\/p>\n<p> R\u00e9f\u00e9rences: <a href=\"http:\/\/www.conseil-etat.fr\/ce\/home\/index.shtml\">Conseil d&rsquo;Etat<\/a>, 10 janvier 2007, <a href=\"http:\/\/www.codever.fr\/\">CODEVER<\/a> et autres, req. n\u00b0 286701 et suivantes.<br \/> Circulaire du 6 septembre 2005 relative \u00e0 la circulation des quads et autres v\u00e9hicules \u00e0 moteur dans les espaces naturels <a href=\"http:\/\/www.ecologie.gouv.fr\/article.php3?id_article=4875\">(bulletin officiel du Minist\u00e8re de l&rsquo;Ecologie n\u00b020, 30 octobre 2005)<\/a>.<\/p>\n<p>Pour clore ce sujet sensible, le prochain post du Bolg Moto exprimera notre opinion.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"tCkEP0uEpt\"><p><a href=\"https:\/\/www.leblogmoto.com\/\">Le Blog Moto<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; visibility: hidden;\" title=\"\u00ab\u00a0Le Blog Moto\u00a0\u00bb &#8212; Le Blog Moto\" src=\"https:\/\/www.leblogmoto.com\/embed\/#?secret=2obMGO7si2#?secret=tCkEP0uEpt\" data-secret=\"tCkEP0uEpt\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pour \u00eatre complet sur ce dossier sensible de la circulaire Olin et de son corollaire, l\u2019arr\u00eat du Conseil d&rsquo;Etat du 10 janvier 2007, nous souhaitons donner la parole \u00e0 toutes les \u00ab sensibilit\u00e9s\u00bb concern\u00e9es par ce probl\u00e8me.
